Civil law defines the rights of parties in a transaction while Criminal Law defines the rights of the public and their safety.
In civil law, enforcement is by the parties themselves while Criminal law is enforced by the government in terms of prosecution.
The remedies of Civil Law is normally in the form of damages, which mean compensation to the innocent party while the punishment of criminal law is more severe, ranging from fines to canning, imprisonment to death.
Hope this explains and clear your doubts about the difference between both laws.
Hi Kishnor..
I will try to answer your question.
Civil law is any act or omission which is not necessarily crime and citizens can seek remedies from each other or from the state. In civil law the offended person also called the claimant starts the court proceeding called the suing. The claimant must prove upon reasons of a balance of probability that the defendant is liable for the wrong done. The purpose of the suing is not to punish the defendant but to remedy the claimant for any loss or damage suffered.
Criminal law is any act or omission which is prohibited and punishable by law. In criminal law the states starts the prosecution and the reason is to punish the defendant. The state must prove that the defendant is beyond reasonable doubt guilty for the crime committed.
In a situation there may arise both civil and criminal law. For example under the Health and Safety at Work Act 1974 an employer can be sued my an employee for negligence to remedy any damage he may receive from an accident caused from a poor work environment. At the same time the state can prosecute the employer for breach in the Health and Safety at Work Act by imprisonment or fine.
The difference between the two(civil law and criminal law) is that civil is intended to compensate the injured party whilst criminal law is to punish the party who committed the wrong.
Civil Law regulates & governs the relation of members of the socitety.
Criminal Law govern the relation of members of a society and state (Act forbidden by the Law).
If director fraud in the comapny .What case apply on him?

Trading Standards Services have to be aware of both civil and criminal legislation.
The legal system divides the law into two categories:
* civil
* criminal
Civil law deals with the rights and duties of one individual with another. Redress is by way of compensation to the wronged party. For help, visit Consumer Direct or the Consumer advice - local contacts for further advice section of the website.
Criminal law is concerned with the establishment of social order, and the protection of the community as a whole. People who contravene criminal laws can be prosecuted and, if found guilty, may be fined or sent to prison, or both.
The London Borough of Hillingdon's Trading Standards Service is concerned primarily with the criminal law. We carry out our responsibility by enforcing laws that have been passed by Parliament. Trading Standards cannot choose which laws to enforce. Central government departments are responsible for the policy aspects of laws, so they are the ones to complain to if you do not like what a particular piece of law is trying to do.
wow that sure helped clear up the concepts thanks alot! :)
