Hi All !

In a 10-mark question for explaining the main sources of contemporary law in relation to the English legal system (December 08), how many points should be write per source?

There are 4 sources: Legislation, Case Law, EU and Custom.

Should be write 4 points per source?
Should we number those points or put a bullet point?

Hi Shunmas,

The word ‘contemporary’ means something which is belonging to the present or occurring in the same period of time.


While answering this question you must consider the following:

 Discuss about case laws.
 Include formulation of legislation by the parliament.
 Discuss precedent and include ratio decidendi.
 Use the hierarchy of authority for discussing the importance of precedents.
 Try to include the EU law.

The outline of the answer:

Legislation

 Why is parliament important?
 Delegated legislation

Case law

 Ratio decidendi
 House of lords and Court of appeal

European Union

 Supersedes any existing law prevalent in the UK (in brief)

Custom

 Specific local custom (in brief)
 Role of law commission (in brief)
