Could you please explain 'Overt Discrimination' and 'Indirect Discrimination' and give an example for each of them?

Thank you for your question.

An example of overtdiscrimination would be not giving a woman a job because she is more likely to take maternity leave. Indirect discrimination involves setting a condition or requirement which a smaller proportion of those with the attribute are able to comply with, without reasonable justification. The case of Griggs v. Duke Power Company (http://en.wikipedia.org/wiki/Griggs_v._Duke_Power_Company) provides an example of indirect discrimination, where an aptitude test used in job applications was found "to disqualify Negroes at a substantially higher rate than white applicants".

positive discrimination in Britain and France, refers to programs first created in the United States to redress a history of racial and sexual discrimination. It grants special consideration to minorities and women in hiring and education.

An example could be an advert espically targetting certain ethnic group which in past had been disadvantaged.


I think I have recalled this right from my memoory and Tutor should could confirm to this!

Direct discrimination is said to occur when a person is treated less favourably than others because of factors such as his gender, race or marital status. For example - not promoting a qualified and efficient employee simply because she happens to be married (thinking she will not be able to provide the same commitment to the organisation as a single employee).

Indirect discrimination refers to the conduct or policies which although do not appear to discriminate on the surface, have a greater impact on a particular gender or racial group. For example - hiring candidates that are above six foot in height. In this case significantly less number of women would meet this requirement.

Positive discrimination refers to affirmative actions or policies designed to redress and / or eliminate past or existing wrongful discrimination aimed at minority or non-dominant group. For example – having quotas to better represent women and ethnic minorities in workplaces.
(Am not sure about positive discrimination, pls correct me if am wrong)
