Difference between wrongful & unfair dismissal
1)Wrongful Dismissal: Dismissing employee without giving notice or without following procedure required by contract.
2) Unfair dismissal: Dismissal of employee by unfair procedure or for invalid reasons.
3) Constructive dismissal: Employee resigns because of fundamental breach of employment contract by employer.

An example of constructive dismissal could be: If a manager wants to dismiss an employee but cant find any legal or perfect reason to dismiss him. So he will try to find another way to kick him off. Like he may increase the duty hours or change complete nature of job . I.e. He may ask the accountant to drive the aircraft !

Constructive dismissal occurs when an employer commits a repudiatory or serious breach of an express or implied term of the contract of employment. If due to the employer’s action, there is a fundamental breach of contract i.e. breach of mutual trust and confidence between employer and employee, then the employee can resign and claim constructive dismissal. The employee must prove that he has left due to the breach of contract terms by the employer.
Example
Alan has been working with a company for the last three years. His employment contract contains a provision that his place of work will never be changed. However, his boss unreasonably changes the location of Alan’s work to a location far away from his residence due to which it is not possible for him to work in the company. He resigns from the job. His resignation is due to his boss’s breach of contract terms. There is a fundamental breach of contract between employer and employee; hence the employee can claim Constructive Dismissal.
Decision in Bushnell V Yello Pages Sales Ltd (2000)The employment tribunal held that the claimant had been constructively dismissed as changing the claimant’s place of work was a fundamental breach of contract. Although the reason for dismissal was a reorganisation, which affected many people, the employer was allowed to make this change. However, no consideration was given to the claimant’s personal circumstances or contract. This made it an unfair dismissal.
